NDP Block Refunds to Manitoba Businesses

WINNIPEG — The Kinew government blocked Progressive Conservative legislation this morning aimed at ensuring surplus funds held by the Workers Compensation Board (WCB) are returned to employers.

Bill 228, The Workers Compensation Amendment Act (Distribution of Surplus Funds), which went through second reading today, would require the WCB to distribute surplus funds when the board becomes overfunded.

“While the WCB currently issues refunds through ad-hoc policy, putting this requirement in law brings fairness and predictability for Manitoba employers,” said Roblin MLA Kathleen Cook, who introduced the bill in December. “It ensures excess funds are returned to the businesses that paid in—especially helping smaller employers.”

The bill mirrors Ontario legislation enacted in 2021. Under Bill 228, the WCB could issue refunds once assets exceed liabilities by 15%, and would be required to do so when that ratio reaches 25%.

“It’s encouraging to see Manitoba legislators attempt to move toward the same certainty and fairness Ontario businesses already enjoy,” said Brianna Solberg, Provincial Director for Manitoba, Saskatchewan and the North, with the Canadian Federation of Independent Business (CFIB). “CFIB has long called for a clear, legislated surplus distribution policy. Small businesses deserve predictable relief when reserves exceed the Board’s own targets.”

“Enshrining this process in law would strengthen trust, improve transparency, and ensure surplus funds go back to the employers who fund the system.”
